Terms and Conditions

In order to buy products from Maison Du Biere or use our web site, you must do so according to these terms and conditions. By registering on the website or purchasing through it you are agreeing to be bound by them. Maison Du Biere reserves the right to change these Terms and Conditions by updating this page.

Sales and Delivery

Delivery is defined as delivery by Courier from our Elsecar Heritage site shop.

The cost to the consumer is £6.95 per delivery box of the following:

Buyers will need to produce a valid I.D to prove their age of 18+.

Once you have placed your order, we will send you an order confirmation email relating to that order. Instructions will be included as to how you can then track your delivery.

We aim to have your delivery with you within three working days of receipt of your order. For deliveries to more remote areas, delivery can take longer. For deliveries to offshore islands, delivery prices are available on request. Please email us at tasteme@maisondubiere.com or call us on 01226 805255 for details of these delivery costs.

Normal delivery times are Monday to Friday between 9.00 am and 5.30 pm, but during busy times, deliveries may be made outside of these times. We can deliver to places of work if you request it at the time of order. Orders placed on a Friday will not be processed until the following Monday. If you are not home when the courier attempts to deliver, a card will be left informing you that an attempted delivery had been made. If you do not contact the courier company, a second attempt will be made. You can authorise the courier to leave the order in a certain place – please add in the delivery instructions section on checkout. IMPORTANT : if a request is made for beer to be left unattended we cannot be held responsible if the beer goes missing after the courier has delivered it. If there is no contact after the second missed delivery, the beer will be returned to us and we will credit your account, less the delivery charge.

Availability – Due to fluctuating stock levels, occasionally a product ordered may no longer be available. If a substitution is required, you will be contacted first and given opportunities to choose the replacements, or get a refund.

At Maison Du Biere we aim to deal with all enquiries fairly, confidentially and quickly. We will acknowledge your contact within 2 working days. We will try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved.

Legal entity – When purchasing products on MaisonDuBiere.com, unless explicitly stated otherwise, you are buying from the producer of those products.  MaisonDuBiere.com is a retail outlet through which you ‘buy direct’ from the shop.

Occasionally, the Maison Du biere shop and  webshop will run special offers, discounts and promotions. These offers will be specific to the area where they are promoted and will not be transferable between sales outlets unless
otherwise stated.

Proof of eligibility *will* be required on collection of orders using any membership or employee discount schemes operated by Maison Du biere, otherwise the difference between the normal price and discount price will be charged upon order collection.

 

Prices and payment

All prices are quoted in pounds sterling, and may be per bottle or per case, as marked. The prices include applicable Value Added Tax at the prevailing rate, unless otherwise specified.

We accept payment by all major credit cards in shop, but currently only use PayPal & bank transfers online.

Description and price of the goods

We make every effort to ensure that prices and descriptions of goods shown on our website are accurate at the time you place your order. The price of the goods will be as shown on the checkout page of our website when you placed your order. We will charge you this amount. We always try and ensure that the prices of goods shown on our website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

Occasionally, advertised bottles, cans or kegs may change their relative ABV without notice. Whilst we try to ensure that these are correct on our website, small variances may occur that are beyond our means to correct immediately.

Errors in processing payment

If the payment is processed, but there is an error which results in Maison Du Biere not receiving payment from the customer, Maison Du Biere reserves the right to reprocess the payment at a later date. If this is not successful, the customer will also be asked to pay on the site or in store with an alternative payment method and given a reasonable period of time to complete the payment – usually 14 days.

Age restriction

We won’t sell products to anyone who isn’t 18 years old or over. By placing an order you confirm that you are at least 18 years old.

If you are buying a case of products as a gift – the recipient must also be over 18 years old.

We will verify your age in store through means of a valid ID.

Security

We use PayPal’s secure payment server on our website. We also have security measures in place to protect our customer database and access to this database is restricted internally.

It is your responsibility to protect both your website password and/or your PayPal from being disclosed to any third party.

Cancellations

You may cancel your order for any reason whatsoever at any time up to the date where you collect the product. In order to cancel your order you must contact us directly via the website or e-mail tasteme@maisondubiere.com

Returns

If some or all of the bottles in a case are broken or spoiled when they are collected, you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund.

You must notify us of all products which are due to be returned for any of the reasons stated in this clause within 5 working days from delivery of the products. You must contact us immediately on tasteme@maisondubiere.com

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen’s Advice Bureau.

Intellectual Property Rights

You agree and acknowledge that we own or are licensed to use all copyright, database rights, trademarks and other intellectual property rights in and to all parts of this web site, and to the business of Maison Du Biere, the structure, design and layout of the web site, the styles of the products.

You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.

Maison Du Biere reserves the right to request that any persons, individual and corporate, providing hypertext or other links to the Maison Du Biere web site, other than to our home page, from their own web site or from a third party’s web site, to remove the links immediately if Maison Du Biere at its sole discretion deems them to be unacceptable.

Warranties

We warrant that the products will be of satisfactory quality and fit for their general purpose.

Limitation of liability

We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

loss or damage was not foreseeable to both parties when the contract was formed;

loss or damage was not caused by any breach on the part of the supplier;

loss or damage relates to business and/or non-consumers.

we will not be liable for loss or damage caused by the customer handling the products. In particular we will not be liable for spillages or breakages.

Customers should also be aware of the following inherent risks and warnings:

  1. Alcohol should be consumed in moderation.
  2. A case of our products is heavy, so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.

Sparkling products can be volatile due to the buildup of gas. Extra care should be taken when opening these. Some products may cause staining if spilt so extra care should be taken.

Data Protection

By providing your details at Maison Du Biere on our web site, you consent to Maison Du Biere maintaining, recording, holding and using the information you give Maison Du Biere at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

Maison Du Biere Privacy Promise: We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your products to you (when we do accept deliveries) and to verify your age, e.g. credit reference agencies, the producers and our delivery company. From time to time, Maison Du Biere may send information about discounts, special offers and personalised offers on certain products, including many exclusive deals, unless you have told us not to do so by unsubscribing to the newsletter in the My Account section of the website.

If you opt-out from hearing from Maison Du Biere or third parties, you will only be contacted by Maison Du Biere in relation to any purchases made on our site (e.g. order confirmation emails) or if our terms and conditions change, but we promise to do so no more than three times per year.

General

We shall not be liable for any delay in delivering your products if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.

Maison Du Biere may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.

No contract exists between you and us until we notify you that we have accepted your order and you have collected the goods. We are not obliged to accept your order.

Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction. Here are our details should you want to contact us:
